End Junk Faxes & Text Messages

The Telephone Consumer Protection Act (TCPA) of 1991 prohibits unsolicited faxes as well as other unwanted forms of advertisement including robocalls and text messages. If you do not have a relationship with the party sending you unsolicited faxes, you never gave the party your fax number, and you are not being given the opportunity to opt out of receiving these faxes, you may be able obtain damages for violations of the TCPA.

Junk Faxes

In addition to representing clients with debt collectioncredit report and mortgage issues, Abraham Kleinman also helps consumers in Nassau County, Kings County and the greater New York area end junk fax transmissions. The Kleinman LLC cease and desist service ends collection agency and debt buyer harassment for residents from Staten Island, Manhattan and all surrounding areas.

If you have been receiving junk faxes or other unsolicited messages, it is important to maintain these transmissions for your records. If the faxes do not have a time stamp, be sure to write down important missing information like the date, time of day, and number the fax originated from. The first page of the unsolicited fax should contain information that allows you to opt out of receiving future faxes, and failure to include this information is a violation of the TCPA.

If there is opt-out information available and you request to stop receiving the faxes but continue to receive the transmissions 30 days later, this constitutes a TCPA violation. Individuals who receive junk faxes can be entitled to $500 per page, but an experienced attorney may be able to help you obtain up to $1,500 if the violations were willful or knowing.

Consumers from Queens, Westchester and the greater New York area turn to Kleinman LLC for help with payday loans, landlord tenant notices and merchant receipts disclosing too much credit card information. Abraham Kleinman understands TCPA provisions and can work to obtain damages if you have been the victim of junk faxes. Contact Kleinman LLConline or call our firm today at (516) 522-2621 to see how we can help.
